Please read these Terms of Service carefully. By using the Service, you agree that you have read and understood these terms. These Terms of Service constitute a legally binding agreement between you and Lubbon.
Lubbon may amend these terms at any time. Your continued use of the Service after any amendments constitutes your agreement to be bound by such amendments.
LUBBON IS A TECHNOLOGY COMPANY WHICH PROVIDES A PLATFORM FOR CONSUMERS TO VIEW, OBTAIN OR PROCURE TRANSPORTATION SERVICES. LUBBON IS NOT RESPONSIBLE FOR THE ACTS AND/OR OMISSIONS OF ANY PARTNER.
2. Definitions
- Application: The Lubbon mobile application and website
- Driver: Independent third-party provider of transportation services
- Passenger: User who requests transportation services
- Platform: Technology platform operated by Lubbon
- Service: Transportation booking and matching services
3. User Accounts and Registration
You must provide accurate and complete information when registering. You are responsible for:
- Maintaining confidentiality of your account
- Being at least 18 years old
- Notifying us of unauthorized account use
- Not transferring or selling your account
4. Use of Service
You agree to use the Service only for lawful purposes. You agree not to:
- Violate any applicable law or regulation
- Restrict or inhibit anyone's use of the Service
- Impersonate Lubbon or another user
- Interfere with or disrupt the Service
5. Driver Obligations
- Maintain valid licenses and insurance
- Pass required background checks
- Maintain vehicles in safe operating condition
- Act as independent contractors (not employees)
6. Passenger Obligations
- Provide accurate pickup and destination information
- Conduct yourself respectfully toward Drivers
- Pay for any damage to Driver's vehicle
- Pay all applicable fares and fees
7. Payment Terms
Passengers agree to pay all charges incurred. Payment methods include:
- Cash or approved digital payment methods
- Drivers receive 80% of fare, Lubbon retains 20%
- Pricing may change; current pricing shown before booking
8. Cancellation Policy
Passengers may cancel bookings according to our cancellation policy. Cancellation fees may apply if a Driver has been dispatched. Drivers may cancel in emergencies or safety concerns without penalty.
9. Limitation of Liability
LUBBON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Lubbon from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
11. Dispute Resolution
Disputes shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with Philippine law.
12. Termination
Lubbon may terminate or suspend your account immediately for any reason, including breach of these Terms. You may terminate your account by contacting customer support.
