1. Introduction

1.1. Please read these Terms of Service carefully. By using the Service (as defined), you agree that you have read and understood the terms in these Terms of Service which are applicable to you. These Terms of Service and the Lubbon Policies (as defined below) constitute a legally binding agreement ("Agreement") between you and Lubbon (as defined below). The Agreement applies to your use of the Service provided by Lubbon. If you do not agree to the Terms of Service, please do not use or continue using the Platform (as defined) or the Service.

1.2. Lubbon may amend the terms in the Agreement at any time without prior notice. Such amendments shall be effective once they are posted at www.lubbon.com or the Application. It is your responsibility to review the Terms of Service regularly. Your continued use of the Service after any such amendments, whether or not reviewed by you, shall constitute your agreement to be bound by such amendments.

1.3. If you use the Service in a country other than the country where you registered for the Application (the "Alternate Country"), you must regularly review the Terms of Service applicable in the Alternate Country which can be found at www.lubbon.com as it may differ from the country where you registered for the Application. By using the Service in the Alternate Country, you agree to be bound by prevailing Terms of Service applicable in the Alternate Country.

1.4. LUBBON IS A TECHNOLOGY COMPANY WHICH PROVIDES A PLATFORM FOR CONSUMERS TO VIEW, OBTAIN OR PROCURE TRANSPORTATION SERVICES. DEPENDING ON THE SERVICES IN QUESTION, THE SERVICES MAY BE SUPPLIED BY LUBBON OR A PARTNER. WHERE THE SERVICES ARE PROVIDED BY A PARTNER, LUBBON'S ROLE IS MERELY TO LINK THE CONSUMER WITH SUCH PARTNERS OR TO ENABLE THE CONSUMER TO VIEW INFORMATION IN RESPECT OF THE PARTNERS' SERVICES. LUBBON IS NOT RESPONSIBLE FOR THE ACTS AND/OR OMISSIONS OF ANY PARTNER OR INFORMATION RELATING TO THE SAME. PARTNERS SHALL BEAR ALL LIABILITY IN RELATION TO SUCH SERVICES. PARTNERS ARE NOT, AND SHALL NOT HOLD THEMSELVES TO BE AN AGENT, EMPLOYEE OR STAFF OF LUBBON AND THE SOLUTIONS PROVIDED BY PARTNERS SHALL NOT BE DEEMED TO BE PROVIDED BY LUBBON.

In these Terms of Service, the following words shall have the meanings ascribed below:

3. User Accounts and Registration

3.1. To use certain features of the Service, you must register for an account. When you register, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account and password.

3.2. You must be at least 18 years old to create an account and use the Service. For Driver accounts, additional age and licensing requirements apply.

3.3. You agree to notify Lubbon immediately of any unauthorized use of your account. Lubbon will not be liable for any losses caused by any unauthorized use of your account.

3.4. You may not transfer or sell your account to any other person or entity. Lubbon reserves the right to suspend or terminate accounts that violate these Terms.

4. Use of Service

4.1. You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Engage in any conduct that restricts or inhibits anyone's use of the Service
• Use the Service to transmit any advertising or promotional material
• Impersonate or attempt to impersonate Lubbon, a Lubbon employee, another user, or any other person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service

4.2. Lubbon reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

5. Driver Obligations

5.1. Drivers must maintain valid licenses, insurance, and vehicle registration as required by applicable law.

5.2. Drivers must undergo and pass background checks as required by Lubbon.

5.3. Drivers must maintain their vehicles in safe operating condition and comply with all applicable vehicle safety standards.

5.4. Drivers are independent contractors and not employees of Lubbon. Drivers are responsible for all taxes and expenses related to their services.

6. Passenger Obligations

6.1. Passengers must provide accurate pickup and destination information.

6.2. Passengers must conduct themselves in a respectful manner toward Drivers and must comply with Driver's reasonable instructions.

6.3. Passengers are responsible for any damage they cause to a Driver's vehicle.

6.4. Passengers must pay all applicable fares and fees for services rendered.

7. Payment Terms

7.1. Passengers agree to pay all charges incurred through their account, including applicable taxes and fees.

7.2. Payment can be made via cash or approved digital payment methods.

7.3. Lubbon reserves the right to change pricing at any time. Current pricing will be displayed before booking confirmation.

7.4. Drivers receive 80% of the fare amount, with Lubbon retaining 20% as a service fee.

8. Cancellation Policy

8.1. Passengers may cancel bookings in accordance with the cancellation policy displayed in the Application.

8.2. Cancellation fees may apply depending on the timing of the cancellation and whether the Driver has already been dispatched.

8.3. Drivers may cancel accepted rides in cases of emergency or safety concerns without penalty.

9. Limitation of Liability

9.1. LUBBON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9.2. Lubbon's total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount paid by you to Lubbon in the twelve (12) months preceding the claim.

9.3. Lubbon is not responsible for the acts or omissions of Drivers or other third parties.

10. Indemnification

You agree to indemnify and hold harmless Lubbon and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Dispute Resolution

11.1. Any dispute arising from these Terms shall be resolved through good faith negotiations between the parties.

11.2. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the laws of the Philippines.

11.3. These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

12. Termination

12.1. Lubbon may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12.2. Upon termination, your right to use the Service will immediately cease.

12.3. You may terminate your account at any time by contacting Lubbon customer support.

13. Changes to Terms

Lubbon reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Platform. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
